Did you know that the U.S. DOT has implemented a system for trucking and transportation companies where violations from roadside inspections that affect your CSA safety scores can be petitioned for review and removal? The U.S. DOT allows you to challenge, review and remove violations issued by FMCSA officer or a state trooper. State troopers make mistakes. Every company has the right and is given an opportunity to challenge and request removal of such incorrectly issued violations from their safety record. What can you challenge?

Anything you do not agree with. Examples include:


  • Violations for unpaid UCR before the month of March (a new deadline for UCR has been issued)

  • Obstruction of view (GPS, phone, ipod) violations if within regulatory distance from window edges

  • Inspections on vehicles that were not driving under your authority

  • Missing clean inspections from your records

  • Mechanical defects where a licensed mechanic did not agree with the police officer's findings

  • Use of left lane when necessary to avoid an accident or dangerous situation

  • Crash Preventability Determination Program (CPDP)

    The FMCSA announced the start of a Crash Preventability Determination Program, or CPDP. As of May 1, 2020, as a part of Data Quality you may request a data review to evaluate the preventability of the crash under eight categories, as specified. Any eligible crashes which occurred on or after August 1, 2019, provided the crash has been not preventable, would be excluded from the Safety Measurement System so as they will not impact negatively the CSA score. This is particularly important as these not-preventable crashes will show as determined not-preventable, on the Pre-Employement Screening Program.
